IMPORTANT SAFETY NOTICE

  • The British Mountaineering Council states that … “rock-climbing, hill-walking, and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own activities and involvement“… We endorse that statement.

  • Whilst each Climber’s Path film / pack provides a detailed demonstration of how Henry Castle climbed an iconic route in the past, it cannot simply be used as a rigid blow by blow guide as to how to climb that route now or in the future. It is an abridged historical recording of how Henry climbed it for himself on that given day. If and when you climb it, the rock, route, conditions, and in-situ protection may not be the same as on the day the demonstration was carried out.

  • It is vitally important that you recognise that YOU are responsible for your own safety and that rock, weather conditions, vegetation, and the condition of in-situ protection can change, and that individuals’ fitness and abilities vary. Consequently, on the day you visit a climb, it is essential the route taken, gear placed, and techniques used are decided by yourself, based on your own assessment of your ability, and the conditions before you at the time. Do NOT simply copy the climb, or gear used, in a Climber’s Path film / pack.

  • No reliance should be placed on the accuracy of the historical description within a Climber’s Path film / pack.

  • The fact that each Climber’s Path film / pack shows a named route being climbed, does not mean it is safe to climb that route.

  • Referring to one of these Climber’s Path films / packs of a given climb, prior to climbing it, does not make it any less dangerous. (The film / pack is not a substitute for experience and proper judgement).

  • These Climber’s Path films / packs detail an individual’s historical climbs. They are not a substitute for an on-site climbing instructor, and must not be used as one.

  • The list of equipment used by Henry Castle on a given climb, is simply that. A list of the equipment used by him on the day. It is not a definitive list of the equipment to use on a given climb.

  • Placing the same equipment in the same place and in the same way as Henry Castle did on the day he climbed a route, does not mean the equipment will successfully arrest a fall on the day you climb the route. Every day is different. You must use your own judgement when you select and place safety equipment on the day you climb.

  • Likewise, copying the routes taken and techniques employed by Henry Castle does not mean they are safe on the day you climb.

  • The inclusion of a climbing area in a Climber’s Path film / pack does not necessarily mean that you have a right of access, or the right to climb upon it. Access agreements change, as do timings of bird bans, etc. Refer to current access information before visiting any site.

  • Route animations and topos are approximations, for illustrative purposes only, of the route Henry Castle took during his climb. They are not inch perfect maps of where he climbed. Furthermore, they may not reflect the route as it exists today, and must not be used as “maps of where to climb”. It is not safe to do so.

  • Start Point images are from the day Henry Castle climbed a given route. They may not represent the Start Point as the route exists today.

  • Start Point, what3words addresses can only be viewed as approximate.

  • The grades given to each climb are those from a variety of sources. The accuracy of those sources cannot be guaranteed. Climbers who attempt a route of a given standard should use their own judgement as to whether they are proficient enough to tackle that route, irrespective of the grade listed.

  • On rare occasions, Henry Castle deviates from the named route. Acknowledges he’s done so, and describes how he finds his way back to it. These deviations may be above the grade of the named route.

TERMS AND CONDITIONS

Climber’s Path films are supplied as part of a “pack”. Each “pack” contains: Online Film, Details of the Rack used in the filmed ascent, Directions to the filmed climb, and an Offline Rucksack - comprising a downloadable (to most phones) PDF file containing Location Information for the filmed climb, approximate Topos from the filmed climb, and Start Point image(s) from the filmed climb.

1. Access to and use of these Climber’s Path films / packs / website is provided subject to the following terms:

  • By using these films / packs / website you agree to be legally bound by these terms, which shall take effect immediately on your first use of the films / packs.

  • You confirm that you are over 18 years of age.

2. You have read and understood the contents of the section entitled “Important Safety Notice” and understand that rock climbing, hill walking and mountaineering are activities with a danger of personal injury or death and that you are aware of and accept those risks and that you are responsible for your own safety activities and involvement.

3. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use the films’, packs’, or website’s  content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from the films, packs, or website except for your own personal, non-commercial use. 

Disclaimers and Limitation of Liability

4.  Under no circumstances will the authors, makers, publishers or distributors of these films / packs / website be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of the films / packs / website  regardless of the form of action.

5. The authors, makers, publishers or distributors do not warrant that functions contained in the content will be uninterrupted or error free, that defects will be corrected, or that it is free of viruses or bugs.

6. Our films /packs / website may not work on some operating systems or browsers.

Intellectual Property

7. The names, images and logos identifying the films / packs / website are subject to copyright, design rights and trade marks of the authors, makers, publishers or distributors.

8. Nothing contained in these terms shall transfer ownership (or be construed as conferring by implication transfer of ownership) of any trademark, patent, design right or copyright of the authors, makers, publisher or distributors.

9. You are granted a fully-paid up, worldwide, non-exclusive, personal, non-transferrable licence to view and use the film / pack for your own personal non-business activities. You are not permitted to copy or modify the film / pack, sub-licence your rights, or use the film / pack for any business activities without our prior written permission.

10. You are responsible for maintaining the confidentiality of your Climber’s Path account and password and for restricting access to your computer / phone / tablet  to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure. 

Termination or Suspension

11. We reserve the right at any time to (a) discontinue or suspend the Climber’s Path website, in whole or part, (b) take down any of the Climber’s Path packs in whole or part, (c) terminate, suspend or discontinue your access to the Climber’s Path website and your Climber’s Path accounts, where you are in breach of these terms or (d) change our eligibility criteria to use the Climber’s Path website where required by applicable law.

12. Except where you are in breach of our terms, we will aim to provide 30 days’ notice to you of any of the circumstances set out at clause 11.

13. Despite the wording set out at clauses 11 and 12, we will aim to ensure you have access to a given film / pack on the Climber’s Path website for at least (6) months from the date of your original purchase of it.
